Do you get your bail money back???

The short answer is NO, but let’s discuss discuss why.

Let lay the foundation first, you have been arrested by police and your bail is set and you call a bondsman. The first thing to know is the bonding company did not arrest you or set your bail amount. The bondsman is just a service that can be used for you to get out of jail for your court dates.

Then your first court comes up, this is typically a guilty or not guilty plea day not a trial date. If you plead guilty then the matter is resolved and any fines are between you and the court.

Now if you plead not guilty you usually get another court date. Let’s say you show up for the next court date and the prosecutor or your attorney ask for a continuance? Then another court date is given. You show up for the next one and the state declares that they want to drop the charges against you?

You think to yourself than I should get the money back that I had to pay to get out of jail. This is not true based on the first thing we learned as the bonding company didn’t arrest, charge or prosecute you. We did however give you that time out of jail to attend court and attend court.

However if you are arrested on what we call a “bad warrant” a matter that should not have been issued b/c it was handled and it was a clerical error. In this case if it can be proven before within the bonding companies “report period” (usually within a week depending on the day) many companies will refund the state required 10% and fees >>>> however not required.

We understand this is frustrating when you are found not guilty or the charges have been dropped but remember the bonding company has nothing to do with the charging or disciplinary process > only giving you the opportunity out of jail.

Always remember this however, the bonding company works for you. They should always be a phone call away for non-legal questions. We should always make sure you know when and where to be for court(s).
